§ 1.
GENERAL PROVISIONS
- These Terms and Conditions (hereinafter referred to as the “Terms“) define the terms and rules for the provision of services by electronic means by WIPERAPP (the Service Provider), the conditions for the purchase of Products, the rules for using the Platform, as well as the rights and obligations of the User and WIPERAPP related to the use of the Platform and Products.
- The provision of services by WIPERAPP takes place on the basis of the Terms and the laws applicable in Poland.
- WIPERAPP conducts the sale of digital products, in particular data wiping software, and provides the Account access service via the Platform, within the territory of the Republic of Poland, taking into account the cross-border nature of the Internet.
- Information about the Products, in particular their descriptions, technical and utility parameters, and prices provided on the Product Page do not constitute an offer within the meaning of Art. 66 of the Polish Civil Code.
- Before using the Platform, the User is obliged to read the Terms and the Privacy Policy.
- Contact with WIPERAPP is possible:
- via e-mail – at the address: info@wiperapp.com,
- via traditional mail – at the address: ul. Kominiarska 42b, 51-180 Wrocław.
- Any instructions, technical guides, FAQs, or similar information published by WIPERAPP, including those available on the Platform, in the Store, or on the WIPERAPP website, do not constitute a binding legal obligation nor create additional rights for the User. Such materials are for illustrative and informational purposes only. The rights and obligations of the Parties are determined exclusively by these Terms and the concluded Agreement. In the event of any discrepancy between such instructions and these Terms, these Terms shall prevail.
§ 2.
DEFINITIONS
For the purposes of these Terms, the following terms shall have the meanings defined below:
- Account – the User’s individual panel on the Platform, necessary to launch the Software, enabling the management of the Software and licenses, as well as generating and storing certificates confirming data wiping.
- Act on Providing Services by Electronic Means – the Act of 18 July 2002 on providing services by electronic means.
- Agreement – an agreement for the supply of the Product and the provision of the Service concluded or to be concluded between the User and WIPERAPP via the Store, under which WIPERAPP is obliged to deliver the Product to the User and grant the access to the Account on the Platform, and the User is obliged to pay the Product Price to WIPERAPP.
- Code – a unique code received by the User after purchasing the Product, necessary to activate and use the Product within the Account on the Platform.
- End User – a natural person using the Product for the User’s needs. End Users may only be employees or persons employed by the User under a civil law contract and using the Product for the needs of the User’s business activity.
- End User License Agreement / EULA – license terms and conditions for use of the Software available at https://wiperapp.com/software-end-user-license-agreement/ .
- Entrepreneur – a legal person, an organizational unit without legal personality, and a natural person conducting business activity.
- GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
- Illegal Content – information that, in itself or by reference to an activity, including the sale of products or the provision of services, is not in compliance with European Union law or the law of any Member State of the European Union, irrespective of the specific subject matter or nature of that law.
- Platform – the WIPERAPP internet platform, through which the User purchases Products and gains access to the Account.
- Privacy Policy – a document describing the rules for the processing of Users’ personal data by WIPERAPP, which is available at http://wiperapp.com/privacy-policy/.
- Product – data wiping Software sold by WIPERAPP together with the Account access Service.
- Product Page – a subpage available in the Store containing a description of a given Product along with the Product Price.
- Product Price – a one-time or periodic fee charged by WIPERAPP in accordance with the Product Price List or the Agreement.
- Product Price List – a list of available Products together with their corresponding Product Prices available on the Product Page.
- Service – a service provided electronically by WIPERAPP consisting of providing the User and their End Users with the access to the Account on the Platform and its functionalities.
- Software – a digital product in the form of data wiping software, offered by WIPERAPP.
- Store – the WIPERAPP online store through which the User can purchase Products, located at www.wiperapp.com/shop/, www.wiperapp.com/shop/, www.wiperapp.com/pricing-plans/#price-list and www.wiperapp.com/cart/.
- User – the purchaser of the Product who is an Entrepreneur.
- WIPERAPP – WIPERAPP spółka z ograniczoną odpowiedzialnością [limited liability company] with its registered office in Wrocław, at the address: ul. Kominiarska 42b, 51-180 Wrocław, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for Wrocław-Fabryczna in Wrocław, VI Commercial Division of the National Court Register, under KRS number: 0000998099; NIP [Tax ID]: 8952106773; REGON [Statistical ID]: 365941748; share capital of PLN 5,000.00.
§ 3.
PRODUCTS SOLD BY WIPERAPP
- The User may purchase Products via the Store. The Product consists of data wiping Software and the Account access Service on the Platform, which is necessary to launch the Software and serves to manage it, as well as to generate and store certificates confirming data wiping.
- Products are sold in two models:
- license for a specific number of data wiping operations:
The User acquires the right to perform a predetermined number of data wiping operations using the Software. The license does not entitle the User to perform a greater number of data wiping operations than that covered by the purchased license. In order to perform a larger number of data wiping operations, the User is obliged to purchase another license. The User receives the license for an indefinite period. - subscription:
The User acquires the right to use the Software for a specified period (indicated each time on the Product Page) without a limit on the number of data wiping operations during the subscription period. If the User wishes to perform data wiping operations after the subscription period expires, the User is obliged to purchase another subscription (or buy license for a specific number of data wiping operations).

- A detailed description of the functionalities of the Products and Product Prices can be found on the Product Page.
- After performing data wiping, the User receives a certificate via the Account. The certificate indicates the specific machine and the disk from which the data was deleted. The Certificate shall not be provided if the disk is damaged and it is not possible to perform the data wiping operation.
- WIPERAPP also makes the Software available within a Virtual Machine deployed on the User’s infrastructure, thereby enabling the User to perform data removal operations from multiple disks simultaneously. This solution constitutes a bespoke service subject to an additional fee. To facilitate deployment, the User is required to grant WIPERAPP technical staff remote access to the relevant infrastructure. The purchase of the Product in this form requires individual arrangements with WIPERAPP, provided that these Terms shall apply to the extent not determined individually.
- WIPERAPP provides free technical support for the Software. Support requests may be submitted via email to support@wiperapp.com or through the ‘Issues’ tab available at panel.wiperapp.com (after logging in). Support services are provided between 9:00 AM and 4:00 PM [Time Zone, e.g., CET]. WIPERAPP shall respond to received inquiries within a maximum of 72 hours from the time of receipt.
§ 4.
CONDITIONS OF SALE
- The User may purchase Products via the Store. Purchasing a Product does not require logging in or having an account in the Store. The User may set up an account in the Store to track their order history.
- In order to make a purchase in the Store, the User provides the data indicated in the order form and makes the payment.
- After making the purchase, the User will receive the Code necessary to activate the Product at the e-mail address indicated in the form.
- To launch and use the Software, it is necessary to register an Account on the Platform and activate the purchased Product by entering the received Code.
- The User may have a separate account in the Store (if the User decided to create such an account) and a separate Account on the Platform. The Store account does not allow software activation and management.
- The User, when purchasing the Product, is obliged to provide data that is true, accurate, current, not misleading, and not infringing on the rights of third parties.
- The condition for purchasing Products is:
- possessing the status of an Entrepreneur:
Products are not offered to consumers or entrepreneurs with consumer rights, i.e., natural persons conducting sole proprietorship who conclude an agreement with another entrepreneur concerning their business activity, but this agreement does not have a professional character for them; - acceptance of the Terms and Privacy Policy,
- acceptance of the EULA.
- possessing the status of an Entrepreneur:
- When purchasing the Product, the User represents and warrants to WIPERAPP that they are the Entrepreneur, and, at the same time, that they are not a consumer nor an entrepreneur with consumer rights (in accordance with the definition above). If the User is a sole entrepreneur who has a status of a consumer under applicable laws, the User represents and warrants that the purchase of the Product is directly related to their business activity. In the event of misleading WIPERAPP as to the status held by the User, WIPERAPP is entitled to all legal remedies to evade the legal effects of its own declaration of intent, in particular, WIPERAPP may invoke defects in the declaration of intent (acting in error) or withdraw from the concluded agreement with immediate effect.
- WIPERAPP reserves the right to refuse to process a transaction and to cease providing Services if it has a reasonable suspicion that the transaction or the manner of using the Product violates applicable laws regarding export restrictions or the sanctions regime, in particular those imposed by the European Union. This applies in particular to transactions or Users associated with countries subject to sanctions or high-risk jurisdictions, specifically: the Russian Federation, the Republic of Belarus, the Islamic Republic of Iran, the Democratic People’s Republic of Korea, the Syrian Arab Republic, the Republic of Cuba, the Bolivarian Republic of Venezuela, Afghanistan, the Republic of Iraq, Libya, the Republic of the Sudan, the Republic of South Sudan, the Republic of Mali, the Central African Republic, the Republic of the Union of Myanmar, the Republic of Yemen, the Federal Republic of Somalia, the Republic of Nicaragua, and the Islamic Republic of Pakistan. Furthermore, Users located in any other jurisdiction are strictly prohibited from offering services, selling, transferring, or otherwise making the Product available to entities or individuals located in or associated with the restricted countries listed above. The User shall indemnify, defend, and hold harmless WIPERAPP and its affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with the User’s violation of any such export control laws or regulations. WIPERAPP reserves the right to terminate any agreements with the User with immediate effect if it has a reasonable basis to believe that the User is in breach of this clause.
- By purchasing the Product, the User submits an offer to WIPERAPP to conclude an Agreement. The conclusion of the Agreement takes place at the moment of crediting of the payment by WIPERAPP and upon delivery of an email to the User with the Product activation Code.
- If the Account is set up for a legal person or an organizational unit that is not a legal person but to which the law grants legal capacity, the Product may be purchased on behalf of such an entity by a person duly authorized to represent the entity.
- WIPERAPP is entitled at any time to take actions aimed at verifying the truthfulness, reliability, and precision of the information provided by the person placing the order, including in particular by requesting the submission of a document confirming the authorization to act on behalf of the User, held certificates, attestations, or other documents necessary for verification.
5.
CONCLUSION AND TERMINATION OF THE AGREEMENT FOR THE PROVISION OF SERVICES BY ELECTRONIC MEANS
- The agreement for the provision of services by electronic means between WIPERAPP and the User is concluded at the moment of concluding the Agreement.
- The agreement between the User and WIPERAPP for the provision of services by electronic means is concluded for the period of service provision by WIPERAPP under the Agreement, i.e., for the period during which the User has access to the purchased Product.
- The User may terminate the agreement for the provision of services by electronic means with a 30-day notice period without stating a reason. For this purpose, the User should send WIPERAPP a statement of termination of the agreement to the e-mail address: info@wiperapp.com.
- In the event of termination of the agreement concluded with WIPERAPP:
- The User is not entitled to a claim for a refund of the Product Price;
- The User loses the ability to use the Product.
- WIPERAPP provides access to the Account for 15 months from the date of the User’s last login. Each successive login starts a new 15-month period. WIPERAPP reserves the right to delete inactive Accounts, i.e. those to which the User has not logged in for at least 15 months. Upon deletion of the Account, the Agreement shall be terminated.
- The User is obliged to download Certificates or any other data before the expiration or the termination of the Agreement. After the expiration or the termination of the Agreement, access to the Account and data may be blocked.
§ 6.
RULES FOR USING THE PLATFORM AND PRODUCTS
- Every User and their End Users are obliged to use the Platform and Products in a manner consistent with the Terms, EULA, applicable law, principles of social coexistence (principles of community life), respect for the rights of third parties, and good morals.
- The User bears responsibility for the actions and omissions of their End Users as for their own actions and omissions.
- In order to use the Products, it is necessary to have an Account. To set up an Account, the User should follow the instructions on the Platform or in the e-mail received from WIPERAPP after purchase of the Product.
- The User may determine, at their own discretion, who has access to the Account. The User shall immediately change the Account password acting on their own behalf and at their own risk.
- To use the Platform and Products, the following are required:
- a computer or other device meeting the minimum technical requirements specified in the Software documentation, with Internet access;
- an active e-mail address;
- in the case of the Platform, the latest version of Google Chrome, Apple Safari, Mozilla Firefox, or Microsoft Edge browser, with cookies and JavaScript enabled.
- The User bears the costs of data transmission required to use the Platform on their own according to the conditions defined in agreements concluded with telecommunications operators or other Internet providers.
- It is prohibited to use the Platform and Products to provide unlawful content.
- The User may not post on the Platform:
- Illegal Content, including content infringing on the rights of third parties, content including the image or personal data of third parties without their consent or without another legal basis, content inciting racial, ethnic, or religious hatred, containing pornographic content, praising fascism, Nazism, communism, promoting violence, offending religious feelings, inciting the commission of a crime, or content that violates applicable laws regarding privacy protection or anti-spam, is used to commit crimes, cyberattacks, or fraud;
- content and text, graphic, or sound materials contrary to the principles of social coexistence;
- vulgar, offensive content, commonly considered morally reprehensible, socially inappropriate;
- content that in any other way violates the Terms.
- In the cases referred above, Art. 14 of the Act on Providing Services by Electronic Means may apply, i.e., WIPERAPP’s exemption from liability for storing data of an unlawful nature.
- The User may not take actions aimed at breaking security features, hindering or disrupting the functioning of the Platform, or destroying, deleting, damaging, or hindering access by third parties.
- The User undertakes not to attempt any interference with the source code of the Platform and Software.
- Furthermore, the User undertakes not to attempt any decompilation or other methods of reverse engineering of the source code of the Platform and Software.
- Any attempts to introduce harmful data into the Platform (malware, including bots, viruses, spyware, worms, etc.) are prohibited.
- WIPERAPP does not actively monitor content transmitted, stored, or sent via the Platform and therefore does not bear any liability for content posted by the User.
- WIPERAPP is entitled to block access to the Platform or Products for reasons related to security or principles of social coexistence, e.g., in the event of finding use of the Platform or Products in a manner contrary to the Terms or generally applicable laws.
- The User who violates the provisions of the Terms may be requested by WIPERAPP to cease the violations. The request will be directed via e-mail to the User’s e-mail address provided during the purchase of the Product. In the request, WIPERAPP will indicate the maximum deadline for ceasing violations, and after its expiry, if the User does not cease the violations, WIPERAPP will be entitled to revoke access to the Product, which will be equivalent to the immediate termination of the agreement for the provision of services by electronic means. When deciding to apply and enforce the measures referred to above, WIPERAPP will act in a diligent, objective, and proportionate manner. In the event of applying the measures referred to above to the User, WIPERAPP will provide them with a clear and specific justification explaining why these measures were applied.
- Blocking access to the Platform or Product may also be performed by WIPERAPP based on the analysis of system data in the event of:
- threat of interception of the End User’s access data by malware;
- use of the End User’s access data by software used, among other things, for automatic logging in with high frequency, sending a large number of requests to the server;
- using systems in a manner inconsistent with applicable laws;
- performing actions that may threaten the security of the system and the data processed therein.
- The User and End Users are obliged to keep login data confidential and protect it on their own behalf and at their own risk against unauthorized access.
- WIPERAPP does not bear responsibility for the consequences of unauthorized access to accounts caused by the User’s fault or negligence.
- In the event of loss or suspicion of loss of exclusive control or theft of data enabling logging into the Product, the User should immediately contact WIPERAPP in order to block access.
- Fulfilling the obligation under the Act on Providing Services by Electronic Means, WIPERAPP warns Users about specific threats related to the use of services provided by electronic means. This concerns threats that may only potentially occur, but which should be taken into account despite WIPERAPP applying measures securing WIPERAPP’s infrastructure against unauthorized actions of third parties. Basic threats related to using the Internet include:
- malicious software (malware) – various types of applications or scripts having a harmful, criminal, or malicious effect on the network user’s ICT system, such as viruses, worms, Trojans (Trojan horses), keyloggers, and dialers;
- spyware – programs tracking user actions that collect information about the user and send it usually without their knowledge and consent to the program’s author;
- spam – unwanted and unsolicited electronic messages sent simultaneously to multiple recipients, often containing content of an advertising nature;
- phishing – fraudulently obtaining confidential personal information (e.g., passwords) by impersonating a trustworthy person or institution;
- intrusions into the ICT system using, inter alia, such hacking tools as exploits and rootkits.
- To avoid the above threats, the User should equip their computers and other electronic devices used to access the Platform with antivirus software. Such software should be constantly updated. Protection against threats is also provided by: enabled firewall, updating all software, not opening e-mail attachments of unknown origin, reading application installation windows and licenses, disabling macros in MS Office files of unknown origin, regular full system scans with antivirus and antimalware programs, data transmission encryption, installation of preventive programs (IDS/IPS), and using original systems and applications from legal sources.
- The User should immediately inform WIPERAPP of any case of violation of the Terms by another User, as well as of any suspicion of using the Platform for illegal purposes.
§ 7.
FEES
- The User is obliged to pay the Product Price in advance. Correct payment of the Product Price is a condition for purchasing the Product.
- The Product Price is visible to the User in the Product Price List or specified in the Agreement.
- The User pays the Product Price via a payment operator cooperating with WIPERAPP (the list of payment operators is available before making the payment).
- In the case of purchases made from countries other than Poland, a payment operator’s commission may be added to the Product Price. The amount of the commission is visible to the User at the stage of finalizing the purchase, before making the payment.
- Prices provided on the Platform are in Polish Zloty (PLN) and are net prices (do not include VAT). The amount of VAT payable will be shown before placing an order. VAT shall be calculated based on the data provided by the User in the order form (if the User does not change the location data, VAT shall be recalculated based on the determined location of the order placement).
- WIPERAPP documents received payments in accordance with Polish law. The User will receive a payment confirmation along with the required accounting documents to their e-mail address.
- The User authorizes WIPERAPP to issue VAT invoices and corrective VAT invoices without the recipient’s signature. The User agrees to send VAT invoices and corrective VAT invoices electronically.
- WIPERAPP reserves the right to change the Product Price List by publishing a new Product Price List. Changes to the Price List apply to the Agreement concluded after the change enters into force.
- WIPERAPP does not bear responsibility for the correct processing of payments by payment operators.
- If the User is in delay with the payment of any remuneration due to WIPERAPP for making the Product available, WIPERAPP has the right to suspend the User’s (and their End Users’) access to the Product (Account). WIPERAPP will immediately restore access to the Product after the outstanding payments are settled.
§ 8.
NO WARRANTY
- WIPERAPP provides Products “as is” and “as available”, without any warranties, express or implied.
- WIPERAPP reserves the right to modify, suspend, or cease the sale of Products at any time, with or without notice. WIPERAPP does not bear responsibility towards the User or third parties for any modifications, suspension, or cessation of Product sales. WIPERAPP will make every effort to inform the User in advance about the cessation of Product sales.
- The User declares that they have familiarized themselves with the capabilities and functionalities of the Product before commencing its use.
- WIPERAPP does not guarantee that the Product will possess, achieve, or meet conditions, parameters, properties, or functionalities not expressly guaranteed in the Agreement or in other declarations and documentation of the Product, and does not guarantee in any way, expressly or implicitly, merchantability or fitness for the purpose intended by the User, nor does it guarantee uninterrupted availability of the Product.
§ 9.
COPYRIGHT PROTECTION
- WIPERAPP grants the User a non-exclusive, territorially unlimited license for the Platform to the extent necessary to use its functionalities for the duration of the Agreement.
- The User may not grant sublicenses, and the license itself cannot be transferred to another entity without the express consent of WIPERAPP.
- All photos and other materials (including texts, graphics, logotypes) posted on the Platform belong to WIPERAPP or have been used with the consent of third parties holding copyrights to them.
- Every User as well as any third party having access to the Platform is obliged to refrain from copying, modifying, distributing, transmitting, or using in any other way any intellectual property rights belonging to WIPERAPP and content made available on the Platform, except for using them within the scope of fair use.
- Any interference with or use of the Platform’s source code is also prohibited.
- When using the Platform, the User shall not:
- independently modify the Platform software;
- test the Platform’s functionality or obtain information regarding its operating principles (except for information made available by WIPERAPP) for the purpose of establishing its functionality and mechanism of operation or obtaining source code data, and in particular, undertake any actions constituting so-called reverse engineering;
- extract parts of the Platform or use, modify, distribute, decompile, or reproduce the source code thereof;
- copy photographs and other graphic materials or reprint texts posted on the Platform, including making them available on the Internet, without the written consent of WIPERAPP or another third party holding the copyrights thereto.
- The use of the materials listed above without the written consent of WIPERAPP or another third party holding the copyrights is unlawful and may constitute grounds for initiating civil and criminal proceedings against the person committing such an act.
- It is prohibited to post content on the Platform that infringes on the intellectual property rights of third parties.
- The User shall indemnify WIPERAPP and entities affiliated with WIPERAPP from liability related to the infringement of intellectual property rights belonging to a third party by the User publishing content on the Platform and shall cover all related costs, including reasonable attorney fees and court costs.
- The User also consents to the use by WIPERAPP of their name and logotypes (including trademarks), which they use to designate their goods and services, for WIPERAPP’s marketing and advertising purposes, including in particular for use in any promotional materials, case studies, references, and information about supplying Products to the User. In any case, when using the User’s name and logotypes, WIPERAPP is obliged to care for the User’s good name and reputation. This consent is granted for an indefinite period, and the User has the right to withdraw it at any time, in writing under pain of nullity. Withdrawal of consent does not affect cases of use of the User’s names and logotypes by WIPERAPP prior to the withdrawal of consent.
- The User retains rights to the data and any content entered into the Products. By entering data and content into the Products, the User grants WIPERAPP a limited, non-exclusive license, with the right to grant sublicenses to its subcontractors, to use this data solely for the purpose of providing Services, their maintenance, and development.
§ 10.
PERSONAL DATA PROTECTION
The Administrator of the Platform Users’ data is WIPERAPP. The rules for processing personal data of Users who are natural persons and representatives of Users are defined in the Privacy Policy.
§ 11.
LIABILITY
- WIPERAPP does not bear responsibility for services provided by third parties necessary to use the Product.
- WIPERAPP does not bear responsibility for the effects of Services provided by WIPERAPP to the User if the User causes the Services to be implemented in a manner contrary to the provisions of applicable law or the provisions of the Terms.
- WIPERAPP shall not be liable for any interruptions or difficulties in accessing the Platform or Products caused by low quality or unstable internet connection on the User’s side.
- WIPERAPP does not bear responsibility for the truthfulness and reliability of information provided by the User or the End User.
- WIPERAPP applies appropriate technical and organizational measures to protect User data but does not guarantee their one hundred percent protection against loss.
- The User should regularly create backup copies of their data on their own, including data entered into and obtained from the Products.
- WIPERAPP does not bear responsibility for the loss, distortion, or damage of User data unless it resulted from WIPERAPP’s willful misconduct or gross negligence.
- Neither the User nor WIPERAPP shall be liable for non-performance or improper performance of their obligations caused by force majeure. Force majeure within the meaning of the Terms is considered an event independent of WIPERAPP or the User, external, impossible to foresee, and beyond their control, which occurred after the day of entry into force of the agreement concluded between WIPERAPP and the User based on the Terms, or which meets the criteria for being recognized as force majeure established by the case-law of Polish courts.
- WIPERAPP has the right to a temporary break in the availability of the Platform related to the introduction of technical changes. A single break should not exceed 3 business days. WIPERAPP will exercise the highest diligence so that technical breaks take place during night hours and last as short as possible. WIPERAPP will inform Users about planned technical works via the Platform or e-mail.
- WIPERAPP does not bear responsibility towards the User for damages and non-fulfillment of obligations arising as a result of any technical errors and failures as well as technical breaks independent of WIPERAPP.
- To the fullest extent permitted by generally applicable law, the Parties exclude WIPERAPP’s liability under the statutory warranty [rękojmia] for Product defects.
- WIPERAPP’s liability towards the User, regardless of its legal basis, is limited – both within a single claim and for all claims in total – to the amount of fees paid to WIPERAPP by such User for the use of the Product for the last month before the claim arose, and in their absence – to the amount of PLN 2,000.
- WIPERAPP bears responsibility towards the User only for typical actual damages foreseeable at the time of concluding the agreement and does not bear responsibility for lost profits (lucrum cessans).
- WIPERAPP’s liability is limited solely to damages caused intentionally or due to gross negligence.
§ 12.
COMPLAINTS
- The User has the right to submit inquiries, comments, and complaints in connection with the purchased Products.
- Complaint notifications regarding Products should be directed to the e-mail address: info@wiperapp.com.
- The notification should contain at least: name and surname, e-mail address, description of the reported objections, date of their observation and occurrence.
- If possible, the complaint should contain a screenshot, recordings, or other materials illustrating the subject of the complaint.
- WIPERAPP will respond to a properly submitted complaint within 14 days.
- The response to the complaint is sent exclusively to the e-mail address.
- In a situation where the data or information provided in the notification requires supplementation, WIPERAPP asks the submitter to supplement it within 30 days before considering the notification. The time for providing additional explanations by the User extends the period for considering the notification.
§ 13.
FINAL PROVISIONS
- WIPERAPP will inform about any changes to the Terms by sending information about the introduced changes to the User’s e-mail address or via the Platform.
- Changes will enter into force no earlier than 14 days from the date of informing the User about these changes unless the User accepts the wording of the changed Terms earlier, in particular via the Platform.
- The period indicated above may be shorter in a situation where:
- the change is caused by a change in generally applicable laws, and the time between the publication of the legal act forcing the changes and its entry into force is shorter than 14 days;
- the change is caused by a final decision of a public administration or a final court judgment ordering its introduction within a period shorter than 14 days.
- The User who does not agree to the introduced changes may terminate the Agreement within 7 days from receiving information about the change with effect on the last day before the entry into force of the introduced provisions.
- matters not covered by the Terms, the provisions of the Civil Code and other generally applicable Polish laws shall apply.
- All disputes between WIPERAPP and Users will be settled amicably through negotiations. If resolving the dispute in this way is not possible, disputes will be settled by the court competent for WIPERAPP.
- The Terms apply from 07.02.2026.
